Terms of Service
Effective Date: 13th of May, 2024
These Terms of Service ("Terms") govern your use of the Offinity Diaries mobile application (the "App"), operated by Officience ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.
1. Eligibility
You may use the App only if you are at least 13 years old (or the minimum age required by law in your country) and capable of forming a binding contract.
2. Accounts and Access
You may access the App using your Google account through OAuth authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3. Use of Service
You agree to use the App solely for lawful purposes. You may not:
- Attempt to interfere with or disrupt the App or its networks.
- Use the App to transmit malicious code or unauthorized content.
- Reverse engineer or copy any part of the App without our consent.
4. User Content
The App allows you to create and store personal journal entries ("Content"). You retain ownership of your Content. By using the App, you grant us a limited license to host and process your Content solely for the purpose of operating and improving the App.
5. Intellectual Property
All rights, title, and interest in the App (excluding User Content) are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
7. Service Availability
We do not guarantee uninterrupted access to the App. We may modify, suspend, or discontinue any part of the App at any time without liability.
8. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App will cease immediately.
9. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim is limited to the amount you paid (if any) for the use of the App.
11. Governing Law
These Terms are governed by the laws of Vietnam. Any disputes shall be resolved in the courts of Vietnam.
12. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Effective Date" or through other appropriate means. Your continued use of the App constitutes acceptance of the updated Terms.
